ORDINANCE FOR REGULATION
OF ITINERANT VENDORS
GENERAL:
- DECLARATION OF POLICY
It is the policy of the city to promote the protection of the
public health, safety, and welfare by regulation of itinerant
vendors.
The provisions of this article are to affect this policy.
- GENERAL
AUTHORITY AND DUTY OF THE COUNCIL
The city council or an officer or employee designated by
the council shall implement and enforce this article.
DEFINITIONS:
- ITINERANT VENDOR means a person who engages in a
business of selling goods or services from any structure
or vehicle that
is not affixed
to the ground, or from no structure or vehicle.
- PERSON means
any individual, corporation, association, or other legal entity.
- PUBLIC
RIGHT OF WAY means the area along and either side of the public
roads and streets.
- PUBLIC PROPPERTY means any property open or
devoted to public use or owned by the city, including, but not
limited to, sidewalks,
streets, parkways, and open walkways.
- VEHICLE means
every device in, upon, or by which a person or property may by
transported or drawn upon
a street,
or sidewalk,
including but not limited to, devices moved by human
power.
- DESIGNATED SPECIAL EVENT means any event so
designated by the Council for the purpose of encouraging tourism
or Community
involvement,
such as, but not limited to, an annual Fair or
Business Exposition.
ITINERANT VENDORS:
Itinerant vendors shall not be allowed on the
PUBLIC RIGHT OF WAY at the time of a DESIGNATED SPECIAL EVENT.
VENDORS
ON PUBLIC PROPERTY:
A person shall not occupy public property in
the city for the purpose of selling, distributing, or offering
for sale services or goods,
including, but not limited
to food, drinks, flowers, plants, tickets, souvenirs, or art UNLESS:
- Doing
so in connection with the transaction of official government
business;
- Doing so by authority of a contract with the city to operate
a concession on designated areas of public property;
- Selling,
distributing, or offering for sale only periodicals from a coin-operated
machine by authority of a permit to operate
the machine;
- Operating a vehicle for hire.
RESTRICTIONS FOR MOBILE FOOD UNITS
A food establishment shall not
occupy public property for the purpose of serving, selling, or
distributing food or beverage from a mobile food unit unless the
establishment possesses a valid permit and the unit is being operated at
the site described in the permit.
CITY OF EDOM ANNEXATION PALN
Pursuant to Tex. Local Govt. Code 43.052 (c),
the City of Edom, Texas hereby adopts the following annexation
plan.
If an area contains fewer than 10 separate tracts
of land on which one ore more residential swellings are located
on each
tract, the
area is NOT required to be placed in an annexation plan.
THEREFORRE:
The City of Edom, Texas does not intend to annex any
area that is required to be contained in an annexation plan. Adopted
this
the
11th day of April 2002.
ORDINANCE FOR REGULATION OF PARKING
GENERAL:
- DECLARATION OF POLICY
It is the policy of the city to promote the protection of the
public health, safety, and welfare by regulation of parking.
The provisions
of this article are to affect this policy.
- GENERAL AUTHORITY
AND DUTY OF COUONCIL
The city council or an
officer or employee designated by the council shall implement
and enforce this article.
DEFINITIONS:
- PARKING means pausing movement or ceasing movement
of any vehicle, whether it is attended or unattended.
- PUBLIC
RIGHT OF WAY means the area along and either side of the public
roads and streets.
- PUBLIC PROPERTY means any property open
or devoted to public use or owned by the city, including, but
not
limited to, sidewalks,
streets,
parkways, and open walkways.
- VEHICLE means every
device in, upon, or by which a person or property may be transported
or drawn
upon a street or
sidewalk, including,
but not limited to, devices moved by human power.
- DESIGNATED
SPECIAL EVENT means any event so designated by the Council
for the purpose of
encouraging tourism
or Community
involvement,
such as, but not limited to an annual Fair
or Business Exposition.
PARKING shall not be allowed on the PUBLIC RIGHT
OF WAY or on PUBLIC
PROPERTY at the time of a DESIGNATED SPECIAL EVENT.
DECLARATION OF DESIGNATED SPECIAL EVENT
For the purpose
of encouraging tourism and Community involvement, the City Council
of Edom, Texas does hereby declare that the
EDOM FESSTIVAL OF
THE ARTS
To be held on September 22-23, 2002, and annually
hereafter, shall be designated as a
SPECIAL EVENT
All rules, regulations and ordinances
pertaining to the occurrence of a
DESIGNATED SPECIAL EVENT
Shall therefore apply.
These include, but are not
limited to the regulation of parking and itinerant vendors.
